Key Features of the Section 96 Modification Application

Summary of Section 96(2) Modifications
The Section 96 Application (MOD2010/0056) was lodged on 21st April 2010.
The purpose of the proposed Section 96(2) modifications are to improve the amenity of the residential apartments and the overall design of the shopping centre.
The amendments include an increase of retail floor area from the approved 13,500 m2 to 13,600m2; an increase of commercial floor area from the approved 1,600m2 to 2,200m2; a decrease of floor area for the restaurant from 1,700 m2 to 1,000m2; the addition of 15 residential units, from the approved 195 units to a total of 210 residential units; and an increase of 24 car parking spaces, resulting in a total of 994 car parking spaces for the whole of the development. These amendments will result in the addition of one extra partial storey for three of the four residential apartment buildings and adjustments to the approved building footprints and elevations of the residential towers.
Other amendments include revisions to various conditions of development consent, and design amendments to the Trelawney Street vehicle ramp to demolish the ramp and reconstruct the access at grade.
Voluntary Planning Agreement
A revised Voluntary Planning Agreement (VPA) has also been lodged with the S96 Application.
As part of the VPA, Banna Developments has offered to undertake a community consultation process for the design and upgrade of Eastwood Plaza to the value of $3,400,000.
Section 96 Changes to Built Form
The following two images indicate the changes to the built form from the DA Approved Envelopes to the proposed S96 modifications. The blue envelope is the DA Approval, with the grey envelopes showing the S96 changes. It is noted that the additional height proposed has been set back from the street elevation to minimise visual impact.
